This topic has been hyper-politicized, and this podcast deserved another point of view expressed rather than Tang's binary choice for the Court that they either comply with the Progressive definition of moderation or he and his Progressive brethren will pack the Court.
Progressives have had their way with law making through the Court since WWII. The current Court has rightly tried to return law making to Congress and to state legislatures and to respect the separation of powers that Progressives would prefer to ignore.
